Students who score between 50 and 64 on state Regents exams between this June and August of next year can seek permission from their school district to pass the class and earn credit toward graduation, under a policy approved Tuesday.

Students must normally score 65 or higher to pass a Regents exam.

The state Board of Regents made the change because of the ongoing, uneven impact of the pandemic on students.

"Conditions for teaching and learning have varied significantly across the State depending upon how the pandemic has affected individual communities, schools, families, and students," said a memo explaining the policy.

A student must otherwise have a passing grade in the course to be eligible to receive credit.

The policy affects students who score 50-64 on Regents exams administered in June and August of 2022 and January, June and August of 2023, regardless of what year they expect to graduate.

An appeal to earn credit can be filed by a student, parent or guardian, the teacher of the course or the department chair. A school committee will then determine, according to a state FAQ, whether a student has "demonstrated the knowledge and skills required" to pass the course. The committee must include the principal, another administrator, and three teachers, not including the teacher of the course.

The committee makes a recommendation to the superintendent, who has the final call.

"Superintendents may consider the recommendations of the committee, a recommendation from the student’s teacher or any other evidence presented or collected related to the student’s attainment of the learning standards for the course," state Education Commissioner Betty Rosa wrote in a memo to school administrators.

There is no limit to how many courses can be appealed for a student.

Parents can refuse an appeal sought by a school if they would prefer that their child remain in school for additional instruction.

A similar appeals process was in place before the pandemic for students who scored 60-64 on a Regents exam. But to be eligible to receive course credit, students needed to take the exam twice and seek academic assistance.

The pandemic has made it quite difficult for the state to administer its long-standing Regents exams.

The exams were canceled in 2020.

In 2021, the state wanted to cancel the exams, but the federal government said certain exams had to be offered. So the state administered several of them, but students were not required to pass the exams to earn credit and graduate.

The state decided to offer a full slate of Regents exams this year, saying that doing so provides a "valuable opportunity to determine the extent to which individual students are achieving the NYS learning standards and informs steps the Department can take to foster equity and improve educational opportunities for every student in New York."

But the new rules will allow students who struggle on the exams to stay on the path to graduation.

New York is one of 11 states that still offer "exit exams" that students must take before graduation. But the state is in the midst of a major review of its graduation requirements that could lead to new, or multiple, ways to assess whether students are qualified for a diploma. 

The Board of Regents is supposed to appoint a commission this fall that will review statewide feedback and begin creating recommendations, due to the Regents in 2024.

Over the last five years, the Algebra 2 exam has actually become slightly more difficult to pass. From June of 2016 through 2019, a passing grade required a raw score of 25, or a 29%. In 2020 the passing raw score was raised by three points to 28 (33%).

This was approved in response to the continued impact of the COVID-19 pandemic. To earn a diploma with a lower score of 50 to 64 on a Regents exam, students must have taken an exam during the June 2022, August 2022, January 2023, June 2023 or August 2023 testing periods.
